In Microsoft Hyper-V, snapshots are merged with disks when the machine is shut down. This means that if a snapshot has been taken and deleted, it will not be merged until the virtual machine is off for a long enough period of time to merge the files. We unfortunately don't know how long this period is, as can vary.
It's also worth noting that the merge requires a bit of disk space and this can vary quite drastically, so we can’t specify how much disk space is needed either. If there is not enough room you should receive an error code 0x80070070 for example.
The reason we give this “Error fetching file list for image level backup for VM” error is that if we backup VMs in this state, they are not recoverable. We would much rather fail the backup and allow something to be done about it now, rather than fail a restore further down the line.
So in this case, the problem VM wasn’t off for long enough for the merge to happen.
